A message dated May 11, 2004, was read stating the Senate has passed                                
CSHB 549(JUD) am with the following amendment and it is                                             
transmitted for consideration:                                                                      
                                                                                                    
             SENATE CS FOR CS FOR HOUSE BILL NO. 549(JUD) am S                                     
     "An Act relating to unsolicited communications following an                                    
     aircraft accident."                                                                            
                                                                                                    
                                                                                                    
The message further stated that under Rule 43(b) of the Uniform Rules                               
engrossment had been waived and the following certified amendment                                   
was attached:                                                                                       
                                                                                                    
Page 2, lines 8 - 12:                                                                               
 Delete all material and insert:                                                                    
         "(d) The attorney general or an aggrieved person may institute                             
     a civil action against a person who violates this section.  In                                 
     addition to injunctive and compensatory relief, a civil penalty not                            
     to exceed $10,000 may be imposed for each violation."
